Common questions
How long does a mutual consent divorce take in Delhi?
The law provides a six-month gap between the first and second motion, which the court can waive in suitable cases under the Amardeep Singh precedent. Total time depends on the court and on how quickly both sides agree on terms, often concluding in 1 to 3 weeks.
What documents do I need to file for divorce?
Usually proof of marriage, address and identity proof of both parties, marriage photographs, and income details. The exact list depends on the type of case.
Do I have to attend every court date?
Not always. Some dates can be attended by your advocate, and some stages may be done by video conference. Ask about your specific case.
How is maintenance decided?
Courts look at the income, assets and needs of both spouses. Both sides file an affidavit of assets and liabilities, as directed by the Supreme Court in Rajnesh v. Neha (2020).
